Minister announces state of emergency extension

The Yukon government is extending the current state of emergency order for up to another 90 days.

The Yukon government is extending the current state of emergency order for up to another 90 days.

The order, which invokes the Civil Emergency Measures Act (CEMA), has been in place for more than a year. This move would mark the fifth extension.

Community Services Minister Richard Mostyn made the announcement in a statement in the legislative assembly on Tuesday afternoon.

“Since the COVID-19 pandemic began last year, our government has focused on keeping Yukoners safe,” he told the house.

“On March 27, 2020, a state of emergency was declared under the Civil Emergency Measures Act in response to the pandemic.

“Since then, a state of emergency has been extended four times to ensure the continuity of the tools, flexibility, and capacity needed to keep Yukoners safe,” Mostyn added.

“The latest extension took place on March 3, 2021, and is slated to expire at the end of the day on May 31, 2021.”

When the state of emergency ends, the ministerial orders enabling pandemic response management under the CEMA will expire, Mostyn said.

“In some cases, this may result in consequences that will have a negative effect on Yukoners during the pandemic period. The state of emergency will soon be extended for a fifth time. The extension may be in place for up to 90 days,” the minister said.

“Of course, the state of emergency can be cancelled at any time, or it may, if it continues to be necessary, be extended.

“As we have recently demonstrated when we removed the requirement to self-isolate for fully vaccinated individuals, our government regularly evaluates the ministerial orders issued under the Civil Emergency Measures Act and repeals any that are no longer necessary to keep Yukoners safe from COVID-19.”

By extending the state of emergency for a fifth time, Mostyn said, “our government remains nimble and able to adapt to potential rapid changes in the COVID-19 situation, including monitoring the third wave in Canada and reviewing emerging data on variant spread to inform our decisions.”

Later, Mostyn hedged his answer when asked by a reporter whether he had any idea of whether this could be the last time the state will be extended or whether it will be in effect the full 90 days.

Mostyn said in response the only certainly with COVID-19 is that it’s unpredictable.

He had little else to say in terms of explaining or rationalizing the move.

Predictably, that lack of detail and discussion didn’t go over well with the Yukon Party in its official Opposition role.

Party leader Currie Dixon argued about the need to proceed with the extension without the government proving it’s necessary.

He called that undemocratic and not fair to Yukoners.

The party renewed its calls for an overhaul of the related CEMA legislation.

“It has been over a year that the Yukon Liberal government has been hiding from accountability and refusing to allow democratic oversight of their actions in regards to the pandemic,” the party said in a statement.

“All-party committees have not met and allowed to review the unprecedented number of regulations and ministerial orders brought in.

“During a snap election campaign, the Yukon Party was the only party to promise clear benchmarks and timelines for reopening, and debate on the state of emergency in the legislative assembly,” the party added.

“The Liberals responded by holding a news conference during the waning days of the campaign to fear monger and say that providing a plan was dangerous.

“Now, we are seeing the Liberals change their tune slightly by relaxing restrictions – however, they are still refusing to allow for democratic oversight of extensions of the State of Emergency,” the Yukon Party said.

CEMA’s current wording, the party added, “means that the Liberals will once again be able to extend the state of emergency and use sweeping emergency powers in perpetuity while avoiding democratic oversight.”

The Yukon Party tabled proposed legislation that would see CEMA amended to require democratic oversight of the government during an extended emergency.

The amendments would:

• provide the legislative assembly with oversight and control over the extension of a state of emergency; and

• require that any regulations and ministerial orders be subject to a mandatory review by the legislative assembly or an assembly committee within 45 days of being issued.

“Enough is enough,” said Yukon Party MLA Brad Cathers. “The Liberals have indicated they will be extending the state of emergency for a fifth time, and once again the Opposition has not been provided briefings with officials on why these decisions are being made, nor will the legislature have the ability to provide oversight.

“The basics of democracy include holding the government to account, and the Liberals continue to avoid this most basic of democratic process.”

NDP Leader Kate White said, “The Yukon NDP recognizes the importance of the pandemic response under the Civil Emergencies Measures Act and fully expects the state of emergency to be maintained so we can keep measures like self-isolation for unvaccinated folks in place.

“We also believe in the importance of clarity and the timely sharing of information,” White added.

“If there should be any lesson learned by any level of government since March 2020, it is the importance of clear and concise communication.

“People want to know and understand the rules and regulations that affect them, and they want to understand what they need to do to meet those rules.”

Unfortunately, the NDP leader added, “communication around rules and regulations has not always been clear. A recent example is the May 21 press release that contained next to no information about next steps for restaurants and bars.

“These businesses were left wondering about what they would be able to do today as restrictions changed, because the same press release does say that, for indoor and outdoor gatherings, funerals, weddings, faith-based services, gyms, and recreation centres, physical distancing would still be required.

“But — great news — after looking online all weekend, new guidelines were posted on the yukon.ca website on May 24.”

Memory is foggy, but didn't we read earlier that enabling CEMA is required in order to control our YT borders? At least one border control seems to be hit & miss, but if CEMA is required then the question we should ask ourselves is whether we want borders fully opened up. If your preference is to fully open borders then by all means complain about the state of emergency, but if you want to continue having borders monitored then state of emergency may be needed.

These Yukon politicians claim to be keeping Yukoners safe?? I’ve never in my life felt so unsafe in the face of their abuse of a flawed Emergency Measure Act to coerce us into restrictions & experimental covid injection that has not been tested for long-term adverse effects. They’re even going after the children. Beware, if you comply they will continue with endless additional measures and booster shots twice a year. And Kate White is gleeful at the thought of isolating the unvaccinated. But they’re completely silent on the vaccine risks and long-term adverse effects, the reality of which has even started to hit some mainstream media. Dr. Mengele could hardly have milked this out better.

If this announcement has not made it abundantly clear that the measures put into place are completely about social control as opposed to public safety, then nothing can or will. What constitutes an emergency? Apparently anything can, which creates an endless justification for restrictions, if not the cessation, of individual liberty. It should also be glaringly obvious that despite a person being able to cut through the rhetoric and political propaganda, that the individual is really just a powerless fleck of dust in the eyes of government. Another cow, herded by their masters in the direction that they are told is allowed at any given moment. Many do not like to hear that, because they feel themselves to be free...but look at our situation with honesty and with the sight of reason. We are ruled, and someone can call the endless rules 'measures of public safety,' but that is simply the ruse. The truth is that fear itself has become the master, because the individual is terrified of what will be lost if they oppose the forces that confine him and her to their designated place in society. Do as you are told...or else!! Those who have pushed back against these forces have been consistently called 'conspiracy theorists,' or other terms meant to degrade and insult. The one's who have mocked and ridiculed these 'theorists' are now realizing that there really is a karmic consequence to treading upon your fellow humans who are simply fighting to protect hard-won freedoms; civil liberties that it is now proven without debate that are altogether too easily lost.
The governments have now confined their herd into two easily identified camps; the vaccinated and the unvaccinated. Compliant and non-compliant. Rewards and 'treats' given to the compliant, and continued 'isolative measures' kept in place for "those unvaccinated folk" which is illegal according to Canada's own bill S-201. Genetic discrimination is illegal, and yet here we are. Do these elected officials even understand their own legislation they are hired to uphold? It is doubtful that they even know about half of it even existing.
So just remember, to those who have mocked the conspiracy theorists as they have championed for their 'free-dumbs.' When the goal-post keeps moving, and your own ability to do anything continues to get shored up more and more in the future, regardless of vaccine status, it can be remembered that the real enemy was fear. History has shown that those who fight for their fellow man and woman (as opposed to against them) have ALWAYS been condemned.

@Moe, I agree with you. I don't make a fuss about the mask, because I figure storeowners and the like would get fined. But I sense a lot of people aren't taking this seriously anymore. Silver and Hanley are making a mistake in attaching the exact same tone as they've used for 14 months, with every advance cautioned with "but it might get worse". I laughed when Hanley said "We're still in recovery". Recovery from what?

The state of emergency thing is getting alarming, though. Politicians are finding it much too easy to keep that in place, and while it is, they seem to feel completely exempt from the normal routine. Silver is more candid with national media than he is with anyone here.

Check out the government contract website: Time for another change order maybe? in addition to his regular wage which should be donated to all the business and ppl that lost jobs over the last year. Aren't we all in this together?? Really?

Dear McD - My words are not disjointed and meaningless. It is a sad irony that you would believe that to be so. I am responsible for what I say nor what you understand. It sounds like you might be experiencing a thought disorder.

You have to prove intent to prove that JSM was lying. A mere discrepancy between your belief system and JSM’s belief system does not make one or the other a liar. That should be the choice we all make when considering other peoples thoughts and beliefs.

It’s called Theory of Mind; the ability to understand that others have thoughts and beliefs that differ from our own and that they act according to those thoughts and beliefs. This is why we are in such trouble as a collective today... The distortion of confirmation bias, a dash of the Kruger dunning effect, diminished capacity, narcissism, and the sociopathology of an unmitigated me-me-me entitlement.

They're testing (on whose behalf, it's anyone's guest...) how far even a minority government can go in manufacturing consent. And right now, I'd say, pretty far, without much effort at all. It's disappointing how blindly obedient this population can be.
And Kate, I had wondered how good a leader you would prove should your party have won. Now I know... The only thing left to wonder is why you didn't simply run under the banner of the Liberals, given how eager you are to endorse every one of their undemocratic and unconstitutional decisions - like insisting on putting their nose into people's medical records...

We have NOT achieved 75%.
As of May 25 77% have received their first shot, 69% their second. You must be on of those in favour of participant ribbons for everyone. Goal is achieved two weeks after all 75% of all eligible adults have been vaccinated.

I'm not sure why you would blatantly lie about something so easily proven false by a simple fact check.

Extending the emergency state for what exactly? To hold on desperately to "some" power because they pretty much lost all their power in the last election? With the slimmest of margins, first they ditch their own policies and jump into the proverbial bed with Kate White in an act showing a marked desperation for power, now they extend the emergency state in another desperate attempt to hold onto what little power they retained in the sellout to Premier-non-Elect White.
I've absolutely had it with this government. They have got to go!

Is anyone surprised? I'm not. CSI: best advice ever. Follow the money. Hmmm isn't Premier Hanley getting 750K a year to beat this horse? MLAs get bucks if they show up to work, or if they don't. Hanley stands to lose a lot of money.

People get to work in their jammies from home, they don't have to pay babysitters, buy gas, work clothes, lunch out, AND they get an extra 2 bucks a day for the inconvenience of having to work from home. The 'grunts'? well.. we have to toil out of the house every day, and are not friendly with anyone on Council. Small business lost their collective *SSes on this. But, a LOT of people make a LOT of money. These are the one's pushing the lockdown decisions? When we stop wearing masks, oh oh.. paper, cheap cotton, little plastic ear stringies, little paper clip nose thingees? Lot of money there. Gone.

There is absolutely no valid reason to keep that Emergency order in place. Lots of not valid reasons that assume validity because we don't do anything about it except write letters. There are so few that are out there actually doing something, while me? I am sorry to say I am a desktop warrior.

Stop being so spineless Currie. Just come out and call for them to end the emergency and return life to normal. No one cares about this bureaucratic talk about democracy and oversight, seriously. It puts people to sleep. What we want is an END to the restrictions, not just for you and Brad to ask questions about them.

Here is a hot tip: People who support all the socialist restrictions are never going to vote for you anyway, so stop trying to play both sides of the fence!!

What is an actual real, full on dirty "state of emergency", really? Does FEAR itself, constitute a state of emergency? Because from the beginnings of this thing, up until the present moment, if you withdraw the FEAR of imminent GOVIDS, you have WHAT emergency, really?
So if every gust of wind that might just become a hurricane constitutes a "state of emergency" then we might as well just make it a permanent fixture of the YUKON, right?
The brave people who settled this place must be roaring with laughter somewhere at the UNPRECEDENTED STUPIDITY of our "leaders". While we're at it, let's just change our flag to a chicken with a syringe.

Just ignore the rules and live your lives. I'll wear a mask in stores if they ask me to because they'll be shut down if they don't enforce the meaningless bossing around of the populace. But as for how many people I can hang out with etc, I am taking the zero cases and over 75% vaccination rate as my signal that it's time to drop the charade.

I too believe the Liberals are enjoying their extra powers, and I am not happy that they are completely excluding the Yukon Party, even from discussions let alone decisions.

Civil disobedience time people. No big deal, no need to get angry, but just do your thing. We've already hit the benchmarks. No wonder the Liberals would not provide a timeline or targets! They do not want to end this state of emergency!

This was supposedly a Public Health Issue from day one. Where in all of this has the Public ever been consulted. Public Health means Public input.
The vaccine does not prevent the Covid 19 infection. It does not prevent Sars Cov-2 transmission. Not one person in Government has mentioned this fact.
The only thing the jab does, supposedly, is reduce the symptoms if you get the Sars-Covid 2 virus...
That is my input on behalf of one member of the Public.

This does not have the scent of good planning with our neighbours towards the bolstering of our economies, but spend the days to maintain a firm grip.

CEMA, or the Civil Emergency Measures Act defines an emergency as a peacetime disaster or war emergency.

It also states: "6(1) The Commissioner in Executive Council may declare that a state of emergency exists in the Yukon or in any part thereof if informed that a war emergency exists or if the Commissioner in Executive Council is of the opinion that a peacetime disaster exists."

So guess what, our legislation leaves this powerful decision up to opinion! Not science, not FACTS!

Look up the Act PLEASE!

More than a year into this situation, with zero active covid (actually, positive PCR tests) cases, the lowest case rate, the lowest "fatality" rate, the highest vaccination rate (well beyond what is required for herd immunity) and Silver, Mostyn and cronies insist they need emergency powers for another 90 days with possibility of additional extensions.

It should be obvious to any rational person that the "emergency" is over and has been for some time. The justification for extending the emergency is based on the thinnest of premises . . . that the emergency extension should be done solely for the convenience of government.

What emergency? Where is it? Certainly NOT in the Yukon.

Silver's recent announcement for a national vaccine registry demonstrates his complete disregard for civil liberties, the Charter and science. He is a totalitarian disguised as a progressive. Why are journalists giving him, Hanley, Mostyn and the other faux humanitarians a pass?

Did you know we reacted faster to 911 than we did to Covid? And guess what, we weren't under a state of emergency.
There is a serious disconnect between what the world is doing (we are allowing people from the U.S. to travel through the Yukon from areas that have no social distancing, Texas for example), and what we're doing.

Either lock the place down or open it up. A half asinine measure isn't the answer. The ONLY benefit is allowing this government to go unchecked, provide less services to the public AND everyone in the public sector takes full wages and does less work. Why don't you just say it, "We want another 3 months off for summer (Please god let it snow the entire time)..."

Also, we're now allowing people to arrive into The Yukon and not self isolate even if they have Covid, as long as they had their vaccination. Which means, you can see an increase in the spread of COVID but the symptoms won't be as harsh.

How are you aligning that theory while there are still questions about the efficacy of the vaccines? "They may need a booster in 3 months." So, uh? You realize that you're putting more people at risk and taking a vacation?
