The Yukon government is finding out once again the devil is in the details when it comes to implementing promises it has made.

This time the devil is in how to administer the loosened health restrictions for travellers promised for May 25.

The government has said any Yukoner – and Canadian – who is fully vaccinated won’t have to serve out the 14-day self-isolation requirement to enter the territory if they can prove their status.

On Tuesday afternoon in the legislature, Health and Social Services Minister Tracy McPhee was under attack by the Yukon Party over the vaccine passports the government is working on.

Yukon Party Health critic Brad Cathers asked McPhee three times if the territory’s privacy commissioner had been consulted on the issue to confirm it would be legal to access Yukoners’ health records pertaining to vaccinations.

He said he suspected there could be legal problems with the concept of people signing a waiver to let government-approved workers examine their health records to a limited degree to confirm vaccination status.

Three times, McPhee did not provide a clear answer.

Later, as the minister talked to reporters, she finally acknowledged she had no knowledge as to whether Diane McLeod-McKay, the privacy commissioner had been involved in the discussions at all surrounding the vaccine passports.

“No, I haven’t spoken to the commissioner,” McPhee said when asked that directly.

She then added she had no idea whether any of her staff had contacted the commissioner for her thoughts on the situation.

“I have 2,200 people working in Health and Social Services,” McPhee said.

She added she believed her staff has more than enough expertise to evaluate the passports without input from the privacy commissioner’s office.

McPhee herself served as the commissioner for five years.

The process for any fully vaccinated Yukoners returning home is that they would provide some kind of paper documentation indicating they have been vaccinated and waited more than two weeks to travel after their last inoculation before they travelled.

To avoid having to self-isolate for 14 days, the card would be accepted as the first level of documentation.

Travellers would then be offered a waiver to sign that would allow electronic examination of their records at a later point to confirm their vaccination status.

They would also sign a declaration promising the information was true before going on their way.

The question also arose during this morning’s COVID-19 briefing.

Reporters intensely questioned the chief medical officer of health, Dr. Brendan Hanley, and Premier Sandy Silver on the subject. Again, there were few definitive answers.

Silver didn’t directly answer when asked why McLeod-McKay hadn’t been consulted.

He said he thought the people at his disposal had more than enough expertise and that the privacy commissioner could “check out the information” that’s been made available to the public” if she’s interested.

It was also unclear if the system for Yukoners will be fully operational by Tuesday, just after the Victoria Day long weekend, when the loosened health restrictions for travel kick in.

A CBC reporter asked if travellers will have to wait while their records are checked – or possibly self-isolate for a day or two until confirmation came in.

Hanley indicated that wouldn’t be the case, and suggested the information could be checked immediately for Yukoners.

British Columbia residents will also face fewer barriers, as there is better co-operation between the province and territory than other jurisdictions.

Silver said repeatedly that the process is still a work in progress – six days before the system is to be ready.

McPhee conceded the access to health records is a slight breach of health privacy. She said it’s not unlike what other countries do before they allow visitors in for other communicable diseases, such as yellow fever.

It’s not clear yet how the system would work to prevent someone with access to the system to further delve into private information.

When Cathers talked to reporters Tuesday, he said he found it very interesting that McPhee wouldn’t give him an answer on the issue when he had asked three times, but would provide reporters with a yes or no response.

He is still concerned about the failure to contact the privacy commissioner, saying he can’t understand why there was such reluctance.

Elaine Schiman, a spokesperson for the commissioner, said “the Yukon government has not included the Yukon Information and Privacy Commissioner (IPC) in any discussions on the planning for a certificate/passport/proof of COVID-19 vaccine.

“She can’t comment any further until she sees what the details of such a plan might be.”

In a joint statement this morning, privacy and information commissioners from across Canada said governments should approach the issue cautiously.

The statement read: “Privacy should be front and centre as governments and businesses consider COVID-19 vaccine passports as a tool to help Canadians return to normal life,” say Canada’s privacy guardians.

“Vaccine passports would allow people to travel and gather again and could support economic recovery while protecting public health.

“They would, however, require individuals to disclose personal health information about their vaccine or immunity status in exchange, potentially, for access to goods and services, for example, restaurants, sporting events and airline travel,” the statement added.

“While this may offer substantial public benefit, it is an encroachment on civil liberties that should be taken only after careful consideration,” federal, provincial and territorial privacy commissioners and the ombuds of Manitoba and New Brunswick said in a joint statement issued Wednesday.

“Vaccine passports must be developed and implemented in compliance with applicable privacy laws. They should also incorporate privacy best practices in order to achieve the highest level of privacy protection commensurate with the sensitivity of the personal health information that will be collected, used or disclosed,” the statement says.

It was endorsed during the annual meeting of federal, provincial and territorial access to information and privacy guardians. The Manitoba ombudsman hosted the meeting, which took place virtually, given the pandemic.

The officials said, “In light of the significant privacy risks involved, the necessity, effectiveness and proportionality of vaccine passports must be established for each specific context in which they will be used.

“In other words, vaccine passports need to be shown to be necessary to achieve the intended public health purpose; they need to be effective in meeting that purpose; and the privacy risks must be proportionate to the purpose, i.e. the minimum necessary to achieve it.

“Further, vaccine passports, whether introduced by governments or public bodies for public services, or by private organizations, need to have clear legal authority.

“In addition, organizations considering vaccine passports should consult with the privacy commissioners in their jurisdiction as part of the development process.”

The statement also notes that “any personal health information collected through vaccine passports should be destroyed and vaccine passports decommissioned when the pandemic is declared over by public health officials or when vaccine passports are determined not to be a necessary, effective or proportionate response to address their public health purposes.

“Vaccine passports should not be used for any purpose other than COVID-19.”

It could be worse. If the Yukon Party had won the election, we might have a Health Minister like Brad Cathers or Scott Kent who have no formal education and next to no experience in the private sector. Basically career politicians who will keep running for office until they die since they can't do anything outside of their cozy elected positions. Maybe it's just me, but I think people should serve 2 or maybe 3 terms and then go back to the real world. They shouldn't sit at the trough and basically put roots into the ground.

Just move on already, we've reached herd immunity, those whose choose not to vaccinate do so of their own choice so why spend millions of dollars and infringe on privacy rights trying to convince a few when it makes no difference at all.

@ Louis Pasteur - The level of ignorance within your post makes me wonder about who you really are and what forms of trauma you must have sustained throughout life that you would so easily give it away and suggest that others do as well. Absolutely concerning.
Perhaps it’s best if we just wash our hands of you... Please forgive the pun but it seemed the best indirect way to suggest that you are espousing quackery.

In a democracy every citizen has an obligation to assert his/her/their freedoms. Passive acquiescence to unnecessary restrictions of one’s freedoms is COWARDLY! It is the quickest way to destroy a society.

As Louis Pasteur once said: Worship the spirit of criticism. If reduced to itself it is not an awakener of ideas or a stimulant to great things, but, without it, everything is fallible; it always has the last word.

We need to honour and protect the right to criticize not shut it down and make a mockery of it. You will not start us down that slippery slope of inhuman debasement. What sort of childlike response is that? If you don’t like it then don’t do it... Don’t participate in society unless you are “one of us” - F$#% you and the horse you rode in on!

But what about when people who can't get the vaccine attempt to travel? Or when they want to work in the service sector? Will they wear a yellow star? I don't understand what a passport does or doesn't do differently.

With the vaccine you still (please correct me if i'm wrong) have the same ability to transmit the virus and to get the virus, so what's the point of the passport, other than making it inconvenient for people that can't get the vaccine?

Just like the vaccine, providing consent to your health records is optional.
Similar to a Drivers license or Passport. No one MAKES you get one but if you want one you just meet or exceed certain expectations.

Feel free not to get the vaccine or the proof of vaccine. Your choice. Also, stop whining about absolutely everything.

Watching government struggle with such simple, basic issues from the outside is truly a site to behold. If you're going to go this route you've obviously already made the ethics decision that the pros (preventing COVID) outweigh the cons (forcing people to prove their vaccine status).
Since vaccinations status is a simple yes/no question that is all the information you make available to the person doing the review. No, obviously the person shouldn't be able to see that you had a vasectomy or have high blood pressure. After that it's your typical, run of the mill safe data handling processes which shouldn't really be different from the myriad other forms of sensitive data government handles. This really isn't rocket science folks. Sigh. Government.

Vaccine Hesitant - The existence of people who can't get the vaccine because of allergies or their immunocompromised status is exactly why we can't allow people who simply choose not to be vaccinated to bring the virus into the territory. Those who choose not to be vaccinated always put forward the argument "why do you care if I'm vaccinated if you think the vaccine protects you". The answer to that question (which is usually just ignored) is people who legitimately can't get vaccinated.

Doesn't even respect her own past office of Privacy Commissioner.
This woman obviously has no integrity and thinks she is above everyone and everything. "Just do as I say, you mere Peons, and don't question anything!"

Having had the vaccine for Yellow Fever, etc and having passed international borders that require documentation of it, I can confirm for you a paper document is all that is required. Little yellow vaccine logbook you hand over at the same time as your regular passport. It has your vaccine history, dates and stamps from the clinics.

Why did the Yukon COVID clinic refuse to sign the vaccine logbook already approved through international legislation when I brought it with me on the days I got the jabs? A solution already exists, but the Yukon thinks it’s too special to get on board. A feeling you often see coming out of the ‘real Yukoner’ crowd which is just a mask over their fear of new and different.

The idea of submitting the honest folks to an electronic check of their complete health records over and above the paperwork just because a few others will produce forgeries is a step too far. Canadian legislation and precedent does not allow for this. We already know the Yukon population is now protected through a high rate of vaccine uptake. This in and of itself makes the justification for upgraded scrutiny and privacy violation null and void.

To Yukon politicians I say this: You’ve done a good a job. Maybe even better than any other jurisdiction in the world. Only two deaths linked to COVID and those links were (can we at least agree) full of complicating factors. Find your sense of proportionality, please. Most importantly always remember the rules and precedents you set today will reverberate into the future. Orders in Council and privacy invasions might strike you as measures for the greater good now, but think on how a ‘disruptor’ type leader might use those powers in the future. Learn from the mistakes of others on this one please. Ponder the office of the American presidency for a moment. Executive orders instead of lasting and democratic change that requires ‘muddling through’ to consensus. Orders that are then rescinded immediately on the first day of a new administration. Is that how you want to govern the Yukon? You have two years under the current agreement. Spend those years as steward, not sovereign.

can still transmit or get covid, then what difference does the "passport" make?

This seems more like a soft trial to see how open society is to having government checkpoints knowing all your information.
Right now we seem to be running for complete loss of autonomy/privacy.

There was suppose to be a national data base set up so regions in Canada could check the data base to see who is vaccinated or not with what type of vaccine and how many times. This information came from Canada health care system.

So let me get this straight. McPhee actually used to be the privacy commissioner but hadn’t even considered the privacy aspect of vaccine passports as the minister? Then she won’t answer questions in the legislature but will happily tell the government crown corporation paid CBC reporter about it. You can’t make this level of incompetency up, it’s like a bad movie that doesn’t end. All you people who voted for this must be so proud of yourselves.

There never was an emergency in the Yukon, yet people like you are so eager to unjustly eliminate others basic freedoms so that the government will give you back a little of what you let them take. I’m not surprised that the government has done what they have done, government always trends to darkness. So until passports are ready/determined, why cannot one show the Vaccination Administration Record as provided when given the injected dose? This records the time, date, your name, prescription number, and type of vaccine given, along with vial lot number and details.
This will eliminate who sees what in your health personal profile and who can get into it.

A year ago, vaccine "passports" would have been verboten (my choice of language is not accidental). Today, most people are clamouring for just such a thing. We've reached herd immunity, but, nonetheless, folks are still demanding that everyone should be vaccinated "or else". They took the risk of getting jabbed with an experimental vaccine . . . why should you be exempt?

What about booster shots? What about variants? Why stop with SARS-COV-2? What about flu vaccines? What about hpv vaccines? What else? After all, it's supposedly all about "keeping each other safe?"

Be careful what you wish for, folks.

If vaccine passports as an interim measure to release the grip of COVID restrictions contravene health privacy laws then the health privacy laws not the vaccine passports should yield. CEMA is paramount legislation and McPhee was the former privacy commissioner anyway. I'm not worried about this. If the Yukon Party wants to make hay backing up the rights of the "vaccine hesitant" and ruin the first opportunity at a bit of freedom responsible vaccinated Yukoners have seen in a long time it certainly isn't going to endear itself to me.

Pretty sure the Liberals are thanking their lucky stars the NDP needed their agenda passed so they came together. I am sure with this vaccine passport drama everyone would be begging for another election. The pandemic has been going on for over a year.....why wasn't every little scenario not looked into? Maybe if some of the 2,200 employees that are working from home, go back to the office they can figure this out.

How much more will you people take.. months ago ALL level of government claimed that vaccine passports/certifications were not in talks and even infringing on the charter of rights.. but I guess the "3rd wave" has scared everyone back into submission? Regardless of your thoughts, only thing clear in this mud is the fact Democracy is dead.. all for 25,000 dead, 30,000+/yr die from Doctors misdiagnosis!

Classic! Lieberals not actually doing there job.... Insane how someone can be asked and reminded of something three times and not follow up on that. Do you know what would happen to most working people if they had three chances and failed to do something? They would be fired. The Lieberas are beyond delusional. Passing this, the rent caps and the budget with no thinking as to any of the actual consequences that may come with there option. Quit being so lazy and do your job.
