Man jailed for ‘serious invasive sexual assault’

Justice Donald Luther sentenced Skyler Menicoche to 23 months in jail this morning for sexually assaulting a 16-year-old girl in 2013.

Justice Donald Luther sentenced Skyler Menicoche to 23 months in jail this morning for sexually assaulting a 16-year-old girl in 2013.

The judge followed the submissions of Crown prosecutor Sue Bogle, who asked for 21 to 23 months in jail.

The defence had sought 12 to 14 months.

“The mitigating factors take a backseat to the aggravating factors,” Luther said.

The age of the victim and the fact the assault was perpetrated on a sleeping woman called for denunciation and deterrence as the primary goals for sentencing, the judge said.

While the victim and Menicoche never discussed her age, the judge noted Menicoche was “reckless in determining her age.”

Menicoche was 27 at the time.

The victim and Menicoche had met through mutual friends in 2013 and started messaging through Facebook.

On Oct. 5, 2013, he invited her to a party.

She showed up with friends, but Menicoche’s mother quickly told them to leave.

Menicoche messaged her later that night, and she returned to his place at around 3 or 4 a.m.

Menicoche and the victim drank alcohol while watching TV, alongside Menicoche’s mother and brother.

Eventually, the girl went to bed.

Menicoche laid down beside her and made advances to her. She refused the advances, and he stopped.

She fell asleep and woke up to Menicoche raping her.

Any identifying detail of the victim, including her mother’s name, are under a publication ban due to the nature of the crime.

Menicoche was “highly involved” in providing alcohol to the teen, before sexually assaulting her, the judge noted as an aggravating factor.

Menicoche perpetrated a “serious invasive sexual assault,” Luther said.

“The victim suffered enormously,” he added.

During the sentencing submissions on Sept. 21, Bogle read a statement the victim had prepared.

“I’ll never forget what happened, which means a lifetime of hurt, and he gets to walk away,” the girl said.

She talked about how she was “emotionally wrecked,” used alcohol to numb her pain to the point of getting sick and had suicidal thoughts.

The victim’s mother explained that day her daughter had been threatened on social media.

The mother accused Menicoche of spreading rumours that her daughter was lying about the assault.

The victim was “nervously awaiting justice,” the judge noted, as the guilty plea was only entered on July 6, 2015, and that there had been “systemic delays” affecting the case.

The judge also noted that since his arrival in the territory in 1988, the frequency of sexual assaults on sleeping or unconscious women has not decreased.

That reinforces the need for denunciation and deterrence, he said.

“I disagree that 12 to 14 months is an adequate sentence to address the serious deliberate nature of the crime that caused prolonged consequences to the victim and her mother,” Luther said.

Menicoche, a member of the Pehdzeh Ki First Nation, was born in Fort Simpson, N.W.T.

The judge noted Menicoche lost his father at age six, and was exposed to his mother drinking at a young age.

He suffered “pronounced emotional abuse” and violence at home, Luther said.

Menicoche is also the father of a young child.

The judge agreed with defence lawyer Gordon Coffin that the prospects for rehabilitation were good.

Taking these factors into consideration enabled Menicoche to have a high territorial sentence. That means he will serve his sentence at the Whitehorse Correctional Centre, instead of a three- to four-year sentence in a federal penitentiary.

Sentences under two years are served at provincial or territorial jails.

“I’ve kept you here in the Yukon,” the judge said, turning to Menicoche.

“Do your very best in jail to follow programming, (and once out) work hard at your job and stay sober.”

The judge also gave Menicoche a 14-day consecutive sentence for a bail breach.

Since Menicoche was taken into custody after the sentencing submissions on Sept. 21, he will serve 23 months and two days.

The offender will be on probation for two years following the completion of his sentence.

The judge directed him to attend counselling for alcohol abuse and sexual treatment.

Correction: He did not plead guilty on Sept 29, he was sentenced that day. He pled guilty on July 6, 2015, almost 3 months later. That seems way too long.

Do you really think she, the victim cares about this on-going discussion between Josey and Nazi? Or if people can spell or not?

This is about a young girl who was raped. She doesn't care what the background of her rapist is or the excuses he used to try and justify what he did. Or if the reader's can write a correct sentence. Go to another social media site and have your debate!

He pled guilty for his crime on September 29th.

In my experience, people plead guilty because they "are" or they are looking for a lesser sentence because the evidence brought forward in a trial would be to their disadvantage. In the latter, this has nothing to do with being sorry for what he did, rather, it is all about his best interests and has nothing to do with her. In both examples, the person is still guilty!

Peace to her and all the other victims of rape! And for the women and men who have been raped and have not provided the police a statement... DO it.... if you have no support in your circle, seek out professionals who will because you may stop a rapist from doing it to another person.

I know it may seem so foreign in this sanitized socialist utopia Whitehorse has morphed into, but there are a few of us out here...get used to it.

It's sad that I can't even use my real name to comment on this case without being pilloried, as is sure to happen if I do.

This appears to be another case of he said/she said, with the judge (once again) siding with the woman. There is no evidence that Menicoche agreed to the rape charge, and the journalist has not addressed that issue. So, I must assume that this was another case of contested testimony.

To men cheering this conviction, I hope and pray you are never accused of sexual misconduct by a woman. Unless you have overwhelming evidence on your side, you WILL be convicted.

We know the victim's family both on her mother's and the father's side. If he get's an early release, this will not happen quietly. Just like a mother bear, she will not tolerate anyone coming between her and her cub.

And just a thought, did you know that there is a Sex Offender register in Canada? But it is not open to the public? That makes no sense. So he is registered for 20 years but no one in the general public will know that information.

I don't think I mentioned my nationality, so maybe you need to broaden your mind. I do think this criminal should have gotten more time and a label that goes along with a predator. I am just kind of sick of people who keep labeling first peoples. Grow up and get out of your fairy tale. And I am not sorry for hurting some feelings which I obviously did do since I received 50 thumbs downs lol. I do hope the victim does receive the help she needs to move on with her life. Move forward, young one and don't let this predator hold you back from living the life you deserve!

Sexual assault is a learned behaviour. Both parties should be offered treatment to deal with what has happened otherwise the cycle will continue. Just for your information, First Nations culture was not rape or sexual abuse based, this was a learned behaviour brought by non-First nations people. So those of you who are slinging the mud, be proud of your rich heritage and the bad behaviours you brought with you to teach the original peoples of this land.

I am pretty sure that if this guy gets out earlier then what he was sentenced for, on the face of a 'sick crime' as this, her friends and family will have something to say about that! When inmates get released early, the newspapers should report this along with a reminder to the community about what their crime was in the first place. I wonder what kind of reaction people will have and how safe the community would feel then, besides knowing that the sex offender treatment here is a joke.

But then, it didn't really matter anyway since the perp got off with such a light sentence. Let's see, with time for - ahem - good behaviour, and time served, he should be out in about 2 months.

Menicoche needed to get at least 25 months so that he served hard time. He would likely know what a rape victim feels like when those difficult months were over.

I do sympathize with First Nations children that had a rough go as youths, however the cycle has to be broken as the victim here is now suffering and will likely have effects that show negatively in her family later on.

"Do your best, work hard" blah Noah blah. These judges must live in silos, because when it comes to common sense they are clueless. This guys behavior is a "red flag" if he gets the time he deserves 2 plus years in a fed pen then he will get proper programming then he just might have a chance. WCC does not have what this guy requires hence he will do 2/3's his sentence and then be out and about on the hunt to rape again! I think most lay people would expect nothing less than a fed sentence for this guy but hold on...he had a bad childhood, his dad was abusive, his mom drank so it's ok your rape will be minimized because he's the real victim and the girl when she's collateral damage...what a disgrace!

Sorry to hear about the victim and what she had to go through. If you are reading this, good for you for stepping forward!! Raping and sexual assault in the north are high and equally high are the women and children who do not come forward and report what has happened to them. You are a pretty strong girl.. good for you! I agree with Judy not everyone with a dysfunctional past rapes women, it is a choice.

June Jackson- No, the article states he was taken into custody after sentencing submissions, and also that he had a prior bail breach, so he's not been in custody during that time. He's got his full sentence to serve and won't get enhanced credit for pre trial custody.

I am sorry "16 year old girl" that you did not get justice. The court, as usual, is treating the criminal like a victim..he's going to get counselling for alcohol and sexual treatment.. jail? really? More likely to be out for time served.. and you get? Nothing.

Yukon justice.. I don't care what happened to Meniocoche when he was a kid..he's 30 years old now and knows better.. but he did it anyway. I know way too many people who had worse childhood's than this dude.. brutal and unrelenting historys'...today? They are the best fathers and husbands ever..because they've been there and determined they would have better for their families and children than they had. Too many use a history as an excuse..
