Contracting firm sued for $15,000-plus

The company that operates Home Hardware in Whitehorse is suing a local contracting company

The company that operates Home Hardware in Whitehorse is suing a local contracting company for more than $15,000 it says it’s owed for unpaid goods.

Cubbon Building Centre Ltd. claims that Bart Butler, the owner and operator of Central City Contracting and Construction, owes $15,114.45 plus interest from an unpaid account.

Now Cubbon is taking Butler to small claims court in order to get the funds.

According to the lawsuit, Cubbon and Central City entered into a written agreement that the financial services company would provide the contractor with a credit account at the independently owned Home Hardware Building Centre on Second Avenue.

Cubbon agreed to provide a monthly statement to Central City setting out the charges.

The contracting company would pay a service charge of 24 per cent per annum on amounts owing in the account.

Central City also agreed to pay for costs incurred by Cubbon as a result of a default under the agreement.

Through the credit account, the contracting company was supplied goods and materials from Home Hardware.

But the suit claims that Central City breached the agreement by failing, neglecting or refusing to pay the balance owing on the credit account.

Cubbon also claims that it made a written demand to Central City for the amount owing but that the contractor continues to refuse or neglect to pay.

Butler and Central City have not responded to the suit and the claims have not been proven in court.

Lawrence: My apologies, of course you are right... people should not be allowed to skip out on debt and never be able to be tracked down to pay it.

I like small claims court... people think that they can walk away without paying...or, I'll pay it later.. try going to the grocery store and saying..I'll just take this food now and pay for it later.. Too many people in the Yukon think they can get you to provide a service then not pay you.. it doesn't matter if you are painting a fence, doing someone's taxes, a taxi ride, letting them run an account..etc. people deserve to be paid... problem is, if this business closes down and heads back out to BC Home Hardware will just be hooped because there is no provisions for collecting from Butler if the account is for Central City and it doesn't exist. They won't even be able to find him.

Why is this in the paper???? Shouldn't it go to court first??? I would be choked if it was me.

I remember when they moved up from BC. Pretty low budget outfit.
